Jaybird Sim Center Membership Agreement

Membership Agreement

This Membership Agreement (“Agreement”) is between Jaybird Sim Center (“Jaybird”) and the individual identified in the member account (“Member”).

1. Membership grant

Subject to payment and compliance with Jaybird policies, Jaybird grants Member non-exclusive access privileges described by the selected membership plan in Jaybird’s systems.

2. Billing; taxes

Member authorizes Jaybird and its payment processor to charge the payment method on file for recurring membership fees, taxes where applicable, policy fees, damage charges, and other amounts described in Jaybird’s Terms and policies.

3. Minimum commitment (recurring plans)

If Member selects a recurring membership plan designated with a minimum commitment, Member agrees to pay for the **full initial commitment period** (currently **three (3) calendar months** unless a different period is shown at checkout).

During the commitment period, Member may not use self-service tools to circumvent the commitment except where Jaybird enables cancellation consistent with these Terms.

4. Early termination

If Jaybird agrees in writing to early termination, Member must pay any **early termination amount** described in the Terms of Service (typically remaining installments for the commitment period) before access is fully terminated.

5. Hours, quotas, and access

Included hours, booking windows, guest rules, and access methods are defined by the plan and posted policies. Jaybird may adjust non-price operational rules with reasonable notice.

6. Termination for breach

Jaybird may suspend or terminate membership for non-payment, unsafe conduct, credential sharing, harassment, illegal activity, or material breach.

7. Governing law

Arizona law governs this Agreement.

8. Entire agreement; order of precedence

The Terms of Service, Privacy Policy, Liability Waiver, Equipment Damage Policy, and Cancellation / No-Show Policy are incorporated by reference. If there is a conflict, the more specific signed template version shown at acceptance controls for that subject matter.
